License Agreement and Download Terms of Service

Application of Terms

(a) Acceptance of this Agreement

By downloading, accessing, viewing, using, or otherwise obtaining any resource, document, file, template, form, software, or other material ("Resource") from NESTICT INFOTECH, and/or by utilizing any related services, you confirm that you have read, understood, and accepted the terms and conditions of this Agreement.

If you do not agree with these terms, you should not download, access, or use the applicable Resource or Service.

(b) Terms Governing the Services

The terms and conditions set out in this Agreement constitute the terms under which NESTICT INFOTECH provides access to downloadable Resources and related Services.

Additional terms may apply to specific products, services, files, subscriptions, accounts, or platforms and will apply where expressly stated.

(c) Customer Purchase Terms

No terms or conditions contained in or endorsed upon the Customer's quotation, acknowledgement, purchase order, delivery note, invoice, correspondence, or other documents shall form part of this Agreement unless expressly accepted by NESTICT INFOTECH in writing.

(d) Additional NESTICT INFOTECH Services

The Customer acknowledges that Resources and Services provided by NESTICT INFOTECH may be used together with other NESTICT INFOTECH products, websites, applications, platforms, or services.

Where applicable, the Customer agrees to comply with the terms and conditions governing those additional products or services.

1. Nature of Downloadable Resources

NESTICT INFOTECH provides access to various digital Resources, which may include:

• Documents.
• Templates.
• Forms.
• Government forms and publications.
• Statutory documents.
• Educational materials.
• Business resources.
• Software and digital files.
• Guides and reference materials.
• Publicly available documents.
• Third-party materials.
• Other downloadable digital content.

Not all Resources available through NESTICT INFOTECH are created, owned, or published by NESTICT INFOTECH.

Some Resources may originate from:

• Government agencies.
• Public institutions.
• Regulatory authorities.
• Educational institutions.
• Businesses or organizations.
• Independent authors.
• Other third-party publishers.
• Publicly accessible sources.

Where applicable, ownership and intellectual property rights remain with the respective copyright owner, author, publisher, government agency, institution, or other rights holder.

2. Third-Party and Government Resources

NESTICT INFOTECH may provide access to or facilitate access to Resources that originate from third parties or government and statutory institutions.

The availability of a Resource on a NESTICT INFOTECH platform does not necessarily mean that NESTICT INFOTECH owns, authored, endorsed, sponsored, or officially represents the organization that originally published the Resource.

Where a Resource identifies a third-party owner, publisher, government department, agency, institution, or other rights holder, that ownership remains with the respective rights holder.

Users should verify important information directly with the original issuing authority where accuracy, authenticity, legal validity, or current status is important.

3. No Transfer of Ownership

Unless expressly stated otherwise, downloading a Resource does not transfer copyright, intellectual property rights, ownership, or other proprietary rights in the Resource to the Customer.

A download generally provides the Customer with a limited right to access and use the Resource for its intended purpose, subject to:

• This Agreement.
• Any applicable license associated with the Resource.
• The rights of the original copyright owner.
• Applicable laws and regulations.

Third-party Resources may be subject to additional licensing terms imposed by their respective owners.

4. Accuracy and Currency of Information

NESTICT INFOTECH makes reasonable efforts to provide useful and accessible Resources.

However, we do not guarantee that every Resource:

• Is completely accurate.
• Is current or up to date.
• Is complete.
• Is free from errors.
• Remains valid after the date of publication.
• Reflects the latest government, regulatory, statutory, or institutional requirements.
• Is suitable for a particular legal, financial, educational, administrative, or business purpose.

Government forms, statutory forms, applications, regulations, policies, and other official documents may be changed, replaced, withdrawn, or updated by their issuing authorities.

Users should confirm current requirements with the relevant official authority before relying on a Resource for an important transaction or legal, regulatory, governmental, educational, or financial purpose.

5. No Professional or Official Advice

Unless expressly stated otherwise, Resources provided through NESTICT INFOTECH are for general informational, reference, educational, or administrative purposes.

The availability of a Resource does not constitute:

• Professional advice.
• Government advice.
• Regulatory advice.

6. Limitation of Liability for Downloaded Resources

To the maximum extent permitted by applicable law, NESTICT INFOTECH shall not be liable for losses, damages, claims, costs, or expenses arising from or relating to a Resource downloaded, accessed, viewed, or obtained through our Services, including where the Resource originates from a third party or public source.

This may include, without limitation:

• Errors or omissions in a Resource.
• Outdated information.
• Incorrect information.
• Changes made by the original issuing authority.
• Third-party content.
• Government or statutory forms.
• Broken or outdated links.
• Incompatibility with a particular software or device.
• Loss or corruption of downloaded files.
• Reliance on information contained in a Resource.
• Failure of a Resource to meet a particular purpose or requirement.
• Changes to laws, regulations, policies, forms, or procedures.

Where applicable law does not permit certain limitations of liability, those limitations will apply only to the maximum extent permitted by law.

7. Third-Party Content

Where a Resource is provided by or originates from a third party, NESTICT INFOTECH does not necessarily verify or independently endorse the content.

NESTICT INFOTECH may act as a platform, distributor, index, repository, or access point for such materials.

The inclusion or availability of third-party content should not be interpreted as an endorsement, sponsorship, certification, or affiliation with the relevant third party unless expressly stated.

8. Government and Statutory Forms

Some Resources may consist of forms or documents originally issued by government departments, public bodies, statutory authorities, regulators, educational institutions, or other public entities.

NESTICT INFOTECH is not a government agency or government department unless expressly stated otherwise.

Users should verify the authenticity, validity, current version, submission requirements, fees, deadlines, and applicable procedures of official forms with the relevant issuing authority.

Where an official version is available directly from the issuing authority, users are encouraged to obtain or verify the latest version from that authority.

9. Copyright and Intellectual Property

NESTICT INFOTECH respects the intellectual property rights of others.

If you believe that a Resource available through our Services infringes your copyright or other intellectual property rights, please notify us using our Copyright Infringement Takedown Policy.

Upon receiving a valid complaint, we may investigate the matter and take appropriate action, which may include removing or disabling access to the disputed Resource where appropriate and legally permitted.

Nothing in this Agreement transfers ownership of third-party intellectual property to NESTICT INFOTECH or to the Customer.

10. Permitted Use

Unless otherwise specified by the applicable Resource license, you may use downloaded Resources for their intended lawful purpose.

You must not use the Services or Resources to:

• Violate applicable law.
• Infringe intellectual property rights.
• Misrepresent the source or ownership of a Resource.
• Remove copyright or ownership notices where removal is prohibited.
• Redistribute paid Resources in violation of their applicable license.
• Resell Resources without authorization where such resale is prohibited.
• Use the Services to facilitate fraudulent or unlawful activities.

Specific Resources may have additional restrictions, and those restrictions will apply where communicated to the Customer.

11. Paid Downloads

Where a Resource requires payment, payment provides access to the Resource under the applicable terms and license.

Payment does not automatically transfer ownership or copyright in the Resource to the Customer.

Unless otherwise stated, fees paid for digital Resources are subject to the applicable refund, cancellation, and service terms displayed at the time of purchase.

12. Account and Download Security

Customers are responsible for maintaining the confidentiality of their account credentials and download access.

You must not knowingly share account credentials or access mechanisms in a manner that violates the applicable service terms.

NESTICT INFOTECH may restrict or suspend access where there is reasonable evidence of:

• Unauthorized account use.
• Abuse of download functionality.
• Fraudulent transactions.
• Excessive automated downloading.
• Copyright infringement.
• Circumvention of technical restrictions.
• Other violations of this Agreement.

13. Availability of Resources

NESTICT INFOTECH does not guarantee that a particular Resource will remain available indefinitely.

We may remove, replace, update, restrict, or discontinue access to a Resource at any time where reasonably necessary, including where:

• The original publisher requests its removal.
• A copyright or intellectual property complaint is received.
• The Resource is outdated.
• The Resource has been replaced by a newer version.
• The Resource is no longer available from its original source.
• Legal or regulatory requirements require removal.
• Technical or operational considerations require removal.

14. User Responsibility

Users are responsible for determining whether a downloaded Resource is appropriate for their intended purpose.

Before relying on an important document, form, template, or other Resource, users should verify:

• Its authenticity.
• Its current version.
• Its issuing authority.
• Applicable instructions.
• Applicable deadlines.
• Applicable fees.
• Applicable legal or regulatory requirements.

NESTICT INFOTECH is not responsible for decisions made solely on the basis of a downloaded Resource.

15. Acceptance of Terms

By downloading or accessing a Resource through NESTICT INFOTECH, you acknowledge that:

1. You have read and understood this Agreement.
2. You accept these terms.
3. You understand that some Resources may originate from third parties.
4. You understand that NESTICT INFOTECH does not necessarily own every Resource available through its Services.
5. You understand that government and statutory documents may be subject to changes by their issuing authorities.
6. You agree to use downloaded Resources lawfully and in accordance with applicable licenses and intellectual property rights.
